Sarah Elizabeth Foster's EP, Gardening From the Ground Up Part 1 from Studio Sarah Records, is the first submission I've received for a 2010 release. Generally around this time, I get a ton of Christmas music offers (which, hey, I will be doing a roundup next week!).
Foster actually has a degree in music, singing French, German, Italian, Portuguese, Spanish, and, of course English. While this EP is only in English, it does showcase her classically singing abilities. My favorite song is actually the title-track, "Gardening From the Ground Up". There's something about this love song, from rain drops to the up-beat jazzy tempo, that I really like. This is in contrast to the opening song, "Wake Up", for a song that's about waking up, it sounds like "take it easy" evening song.
While people will automatically associate Foster to 60s girl singers, I think her vocal styles, would actually lends itself really well to modern indiepop music. I'm certainly interested in hearing what part two sounds like. If you live in New York, Foster will be playing tomorrow, December 4th at Pete's Candy Store in Brooklyn.
FERAL CHILDREN

Feral Children is a "backwoods" band from Seattle, Washington. Their self-titled EP was a free released on Sarathan Records, while their forth-coming album, Brand New Blood, will be available digitally December 8th, while a physical release on January 19th, 2010.
As their name suggest, their music seems, I don't know, wild. Like "grizzly bear", "panda bear, "deerhunter" and "animal collective" wild, and this isn't surprising, considering Scott Colburn (Animal Collective's Feels producer) is their producer on the Feral Children album. Compared to previous bands I mentioned, Feral Children seems more melodic and less experimental. I'm not sure who produced their EP (I rarely get liner notes for digital submissions), but they certainly have that collective-like influence.
I did give the EP a few listens, and not entirely impressed with the singer (is it Bill Cole?). His vocals is very rough, voice cracking comes to mind on tracks like "Saint". While this may possibly be the greatest song done live, listening to it on headphones made me cringe.
Who knows, maybe their album will be much better than the self-titled EP. It is, after all, their first release, I'm sure they'll improve over time. Information on the free downloads, head over to Sarathan Records.

I keep mis-reading this band as Major/ising, so I'm not sure if other people might have the same problem reading the name (it's OK people misread W♥M as "we love music" all the time...)
Mojorising recently moved from Los Angeles from Australia. So prices for their EP at $12 on the merch page might seem high, until you realize it's in AUS dollars.
My impression is that this duo makes some really funky music, but with classic rock attitudes (think Jamiroquai). The funk soul translate well on a few of their songs, "She Woke Up To Me" and "Sooth Me And Use Me". The later is very dancey, I suspect it will play well to a live audience. Incidentally if you are interested in hearing the first song, it's available as a free download.

Lara dismissed Julie Baenziger, aka Sea of Bees, as being too "CocoRosie/Joanna Newsom", and really - what's wrong with that ? As expected, Baenziger's vocal style is that of a small cute child. And also cute is the title of the EP, called Bee Eee Pee. This is a collection of four songs and one intermission song.
All of the songs are pretty minimalistic, usually with just acoustic and Baenziger singing. The stand-out track for me is "Willis", because it does feature a melodic backing music (vs just acoustic alone). Also, the inclusion of the random intro is nice - it explained that this particular recording happens to be the third take.

David Mitchell, writing in the Arkansas Law Review, argues that a circuit judge used too narrow a standard for considering post-conviction relief based on new evidence in the West Memphis Three murder case. Mitchell concludes that a new trial was warranted. Let's hope the state Supreme Court reads the Arkansas Law Review.
A news release summarizes:
The Arkansas Law Review, a publication of the University of Arkansas School of Law in cooperation with the Arkansas Bar Association, has published a lengthy and scholarly article reviewing the legal issues surrounding the innocence claims of Damien Echols, Jason Baldwin and Jessie Misskelley.
New evidence in the case revealed that while no DNA of the convicted young men was found at the crime scene, DNA from Terry Hobbs, stepfather of Stevie Branch, was found in the ligature binding the hands and feet of one of the other children. In addition, some of the country’s leading forensic pathologists have concluded that most of the wounds found on the bodies were, in fact, the result of post mortem animal bites, and not knife wounds, a belief upon which the prosecution based its case.
The well-researched article by David S. Mitchell, Jr., Lock ’Em Up and Throw Away the Key: The “West Memphis Three” and Arkansas’s Statute for Post-Conviction Relief Based on New Scientific Evidence (Volume 62, number 3), reviews the decision by Craighead County Circuit Judge David Burnett, who denied the West Memphis 3’s request for a new trial based upon new DNA and other evidence. In September 2008, Judge Burnett summarily denied Echols’s, Baldwin’s and Misskelley’s respective motions without granting a hearing.
According to the Law Review article, the circuit court employed a very narrow interpretation of the post-conviction relief (DNA) statute (section 16-112-208-(b) (e) to deny Damien Echols and the West Memphis 3 a new trial.
“A close examination of the legal and factual issues presented by Echols’s motion for a new trial reveals the circuit court’s failures on each level, particularly the way the circuit court’s interpretation of the statute eviscerated its purpose.”
“After evaluating the legal arguments presented by the State and Echols on each of these issues, this comment reaches the conclusion that the trial court erred in denying Echols’s motion for a new trial.”
Echols’s case meets the standards set forth in the Arkansas statute as well as the intention of the legislature when the statute was passed in 2001. “The court may then grant a motion for a new trial or resentencing if the DNA test results, when considered with all evidence in the case regardless of whether the evidence was introduced at trial, would establish by compelling evidence that a new trial would result in acquittal. The new evidence is sufficient to establish that any reasonable juror would have reasonable doubt as to Echols’s guilt…”
He concluded, “the circuit court failed in its interpretation of Arkansas’s post-conviction relief statute…it also failed to meet the Arkansas Legislature’s goal of accounting for the ability of new technology to accomplish the mission of criminal law –to punish the guilty and exonerate the innocent.”
The circuit court reasoned that the legislative history of the statute indicated Echols’s testing results were “inconclusive” and required that the motion be denied under section 208 (b). Accordingly, the court gave great significance to the fact that the DNA testing was ordered under a prior version of the statute that allowed that DNA tests could be conducted when the evidence had the “scientific potential” to be materially relevant to the claim of relief. The 2005 statute had a stricter standard that allows only for testing when the results could raise a reasonable probability that the person did not commit the offense. In either interpretation of the statute, Echols, Baldwin and Misskelley meet the standards for a new trial.
The legal community, nationally as well as in Arkansas, has emerged as an important ally in the effort to obtain a new trial for Damien Echols, Jason Baldwin and Jessie Misskelley. The Arkansas Law Review article comes on the heels of the support of the National Association of Criminal Defense Lawyers and the Northwestern University School of Law’s Center on Wrongful Convictions, who jointly submitted an Amicus Brief to the Arkansas Supreme Court on behalf of Echols’s appeal for a new trial.

However, even if you don't like the news because they say, "We don't have any more money in the budget," you would be able to find a freelance job that could help cushion your cash flow.
Raise? What raise? I got a pay cut. Why on earth does she think anyone's going to get a raise any more? This reminds me of watching National Lampoon's Christmas Vacation and thinking, "Christmas bonus? What unicorn is that?"
With Mercury retrograde in late month, just don't buy anything expensive, especially not anything electronic. I would say stop buying computers, cell phones, flat screen TVs, and other pricey electronics after December 7. You can go shopping again after January 18 or so, leaving a little room after Mercury goes direct.
And already did that on Black Friday. Hopefully nothing else will die on me between now and then.
Travel is becoming a very big theme for you with the advent of the two impending eclipses, the first arriving on December 31 as a full moon lunar eclipse, and the second one arriving as a new moon solar eclipse next month on January 15. Eclipses always bring unexpected elements to bear, so it's always best to hold back and wait a few days before taking action. It takes a while to fully understand the message of each eclipse. Keep in mind that eclipses rarely deliver their news all at once, for there is always an Act II, so observe carefully.
The December 31 eclipse will fall in your third house, so your close family relatives may be in the spotlight.

The relative you may be thinking about could be a sister, brother, cousin, an in-law, aunt, or uncle, but NOT likely to be one of your parents. Actually, the eclipse will more likely focus on a woman than a man. One of these individuals may be making news, so you may want to keep your cell phone powered up.
Joy. Drama eruption alert! But again, that's every holiday around here.
There's a very good chance that you will travel on or very near December 31, but it seems you won't go far - only 100 or 200 miles at the most. Because this will be New Year's Eve, it would be best to plan to stay overnight in the town you will visit, even if it is very close to home. This eclipse will be in the highly emotional sign of Cancer, so although as a Taurus you are not an overly emotional creature, others will be on this night. With Mercury retrograde too, people will be distracted or forgetful, so it is not really a night to be driving on the road. Add alcohol and you see the problem - stay safe, stay in the city you are visiting, or hire a limo driver for that evening to get you home.
This eclipse will be in hard angle to Saturn, so you may have to attend to some responsibilities suddenly (and unexpectedly) that may interfere with your plans to ring in the New Year. Stay flexible. Some eclipses affect us not on the day they appear but later. Actually, many eclipses deliver their news one month to the day later, plus or minus five days, so you may be traveling next month, near January 30, or seeing other manifestations of this eclipse come out then.
So, a crappy New Year's where I can't go anywhere and some woman is crying on me? To be honest, that's pretty much every freaking New Year's for me since about 2001. Trapped at home dealing with Parental Drama.
One last possibility exists about how this eclipse may affect you, and it deals with your talent in the communication arts. You may see your book or magazine article be published, or you may unveil a new website or blog. You may be asked to give a speech or hand in an important report or paper. This would be a great way to use this full moon eclipse. If you are on a book tour or speaking tour, you will get quite a bit of publicity.

Now let's turn to Uranus, which has influence over your solar fourth house of home and your fifth house of love, which Uranus is visiting now. Now that Uranus is about to turn direct, both areas are due to get a big boost and developments should be obvious. Watch the days that surround December 1 for a sign that a goal related to home, property, or family, or related to your finding and keeping true love, will improve dramatically. If you've had problems settling a matter related to either area of your life, you will be very gratified by the new environment you are entering into now.
That would be nice as well. I can't say I've heard that Uranus gives a boost to those things, but whatever.
Money will be the topic of conversation on the December 2 full moon, plus or minus four days. This full moon should feel quite friendly, so you may see a commission, bonus, or licensing fee from previous efforts come in. The eighth house will be lit, so this house is one that is associated with one-time chunks of cash rather than steady salary money. With Mars in such fine angle to the Sun and moon, the money seems career-oriented, so if the just-mentioned areas don't sound possible, then the money you see may come in the form of venture capital or a bank loan. It is, however, also possible that you will hear of a court settlement or insurance payout. You may also have to send someone a hefty check, but if so, don't be blue, as your outlook for bringing in more money is actually quite upbeat.
I probably won't hold my breath on that.
On the new moon December 16, you may get a raise or job offer. This new moon will be all about money, so be sure you like the job, dear Scorpio. It's not actually a good time to change jobs due to the impending retrograde planets, for you may get into the job and wonder what you were thinking when you accepted it. However, it is a good time to ask for a raise, so you must do so as soon as that new moon appears. If you are self-employed, you may now see money flow in from entrepreneurial projects you seeded earlier.

Okay, so not going to Mexico this year. Fine by me anyway. Though again, this seems to be all "don't travel." It's interesting having your sun and rising signs opposite from each other: somehow the forecasts all come out alike anyway.
For New Year's Eve, you may be traveling to a distant city. This eclipse will fall in your ninth house of long distance travel, so you may even be going abroad. Saturn will be in very hard angle to the Sun and moon from your twelfth house, suggesting that you might have some sort of interaction with medical personnel at the time. I hope this does not happen, but I am seeing the possibility in the chart.
If you do travel, you will have to take precautions to stay well. Don't drink the water if it is not considered perfectly safe, and don't eat any fruit that you didn't peel first. Carry Clorox wipes or other antibacterial towelettes to wipe down your tray table, armrests, and surfaces in the airplane's toilet. Also go over various parts of your hotel room, from TV remote and phone, to draw pulls, light switches, and doorknobs. Budget cuts in every country have caused cutbacks in cleaning staff, so you can't be too careful, especially with Saturn in the twelfth house.

Eclipses bring sudden changes, but they are very effective in making us move on and evolve into more mature beings. Usually the cause is something completely unrelated to anything you've done or have control over. Because the eclipses will be in the parts of your chart ruling information, attitude, and opinion, you may later say you changed your stance on an important topic or relationship when you began to see things in a new light. Eclipses are broadening, forcing us to see a bigger picture.
Well, that's not bad.
Certain relatives are ruled by the houses involved with eclipses, so you may hear news about an aunt, uncle, cousin, in-law, sister, or brother. If you do travel, family may want to reach you, so you won't want to be out of touch.

I am very happy that the United States District Court dismissed all claims by Terry Hobbs against Natalie Pasdar (Maines) and the Dixie Chicks, in which he alleged he was accused of murdering his stepson Stevie Branch, Michael Moore and Christopher Byers.
Federal Judge Brian Miller, after a thoughtful review of the evidence, ruled that Natalie Pasdar clearly demonstrated her intention to ensure that any remarks and writings she made on the legal aspects of the West Memphis 3 case came from court filings and legal papers.
My heartfelt appreciation to Natalie and the Dixie Chicks for their support for a new trial for Damien, Jason and Jessie. May the Arkansas Supreme Court grant the West Memphis 3 their freedom in their appeals currently before the court.

Before her last song, she introduced The Books by telling this joke about next to the dog, a man's best friend is a book. Next because inside a dog, it's too hard to read.
The Books set up two chairs and their movie projector at 9 o'clock. Remember, this is the Cedar, their shows starts early and ends early (no later than 10:30pm). Which its audience is an older (and probably gainfully employed crowd), so they like early shows.
So, back to the Books, they provided the live soundtrack to their movies. Everything is in sync, no technical problems at all. They even went so far as having a one-minute intermission song as they tune up their instruments. The intermission song features anagrams of the word "Immediate". Everything is calculated.
I find that trying to watch the movie and watching Nick Zammuto and Paul de Jong was somewhat distracting. I think they prefer you watch the screen, because watching the duo play isn't exactly that exciting.

As for the encores, which incidentally is predetermined because of the movies that is associated with the songs, they did two songs. The first is a Nick Drake cover "Cello Song", which Paul explained is their only cover they do. It was for the benefit of the Red Hot organization for Aids awareness. If you recall, I've previously endorsed the organization by buying many of their music releases. Their final song is "An Owl With Knees" from their 2005 album, Lost and Safe.
PS, This is my final concert for 2009 (I hibernate during the winter), I would like to thank everybody for offering shows for me to review. I will be able to accept assignments in March-ish 2010, and/or whenever it stops snowing.

Minneapolis duo Bella Ruse self-classify their sound as “indie folk jazz,” but when Joseph Barker plugs in his electric, as on opener “Push On,” the result doesn’t quite fit the categorization. The sparse, moody guitar and Kay Gillette’s intimate vocals would be as appropriate for a sparse, moody Jim Jarmusch film as for a smoke-filled jazz club. While “Push On” is Bella Ruse’s standout track, the rest of the EP is quietly pleasing. “J’ai Presque Peur” is a smooth Pinot Noir toast to Edith Piaf and “Heart of Everyone” jangles along nicely. When Norah Jones released her debut, I remember being underwhelmed at first, certain that her foray into “jazz” was one clarinet short of Lite FM. However, after a few listens, I warmed up a bit, mostly because beneath the soccer mom ear-bait, I could detect the slightest shade of melancholy, and this interested me. Bella Ruse is interesting in a comparable way (they had me at “kind of sad”). Gillette’s voice calms rather than excites and sure, “Hold Me Close” would probably excite a Meg Ryan character (when she realizes that the Tom Hanks character is The One*); still, revisit “Push On” and convince me there isn’t a little Scout Niblett/Chan Marshall angst beneath the romantic sentiments.
In his track notes, Barker admits that “Push On” was not an immediate favorite. In fact, it took Gillette’s persistence and encouragement from fans to convince him that the song had a place on the EP. Although this baffles me, I also kind of get it. “Push On” is Bella Ruse’s “Hide and Seek”: a stand alone track that deviates from an otherwise comfortable style. There’s a reason why I’ve listened to the song a total of 27 times since I received the EP, except the ‘reason’ is actually a sensation—a slight tingling, milder than goosebumps but equally elusive. My request for the band is simple: more, please. More blood, sweat, tears, booze, ultra-lights, magic fairy dust or WHATEVER combination birthed this beauty. More Pinot Noir, too.
Besides their debut EP, Bella Ruse has also released ‘Twas a Bella Ruse Christmas, a 4-song compilation of Christmas favorites. We beheld a flurry of Mike Huckabee news over the weekend. It featured superficial judgment, predictable if unintended comedy, horrific human tragedy and, of course, a seemingly pathological unwillingness to accept personal responsibility, but rather to blame others.
Events began Saturday in Midland, Texas, where, at a Barnes & Noble book store, thousands were reported to have lined up to obtain Huckabee’s signature on their copy of his latest cranked-out pamphlet for cash, which apparently is a collection of Christmas stories.
Persons interviewed by the local newspaper were quoted as saying the country needed Huckabee to become president and get up to Washington and straighten this mess out. They said they liked his populist conservatism and his TV show on Fox and his straight talk and that he played music.
One person was quoted as saying the best thing about Huckabee was that he was not “all spit and polish.”
There was your superficial judgment.
Huckabee isn’t all spit and polish, of course. But his national political prominence is largely just that.
You take away his spit and polish and you’ve got a decent small-town Baptist preacher and a guy who, reflecting an uncommon willpower and focus, once ridded himself of his considerable obesity and ran a few marathons. I will always give Huckabee admiring credit for that, if not much else.
Then, on Sunday, Huckabee went on a Fox News talk show and said he was disinclined to run for president in 2012 because his television show on Fox was going great. There was your predictable if unintended comedy.
I told you when he ran for president in 2007-08 that he wasn’t really running for president, but for a show on Fox. He was ginning up the glib to try out for a gig. And he got the gig.
Now he’s making good money playing a politician on TV and radio and playing an author in Midland. And now he suggests strongly that he prefers the gig to serving the country. There’s a spirit of public service for you.
About the time he was talking on Fox, four police officers were being gunned to death in the state of Washington. There was your horrific human tragedy.
Soon the authorities were looking for a “person of interest.” This person, Maurice Clemmons, had been sentenced in Arkansas in 1990 to an accumulated 108 years in prison for aggravated robbery and other serious misdeeds.
But, in 2000, Huckabee, then governor of Arkansas, commuted Clemmons’ sentence to make him eligible for parole, which he soon received. Huckabee’s judgment was that Clemmons deserved a break because he’d been but a teenager when sentenced.
Maybe Damien Echols needs to try that, rather than all this hard evidentiary nonsense.
Confronted late Sunday by these events, Huckabee put out a statement saying that, if indeed Clemmons committed these senseless acts, it would reflect an abject failing of the criminal justice system, from the parole officials who recommended the commutation to the Arkansas authorities who bungled a subsequent arrest of Clemmons to the Washington authorities who had the man in custody on a child rape charge just weeks ago only to let him get away on bail and for a supposed psychiatric evaluation.
There was your unwillingness to accept personal responsibility. While it is true that Arkansas authorities misplayed an arrest warrant and lost Clemmons in 2004, that happened only after Clemmons had been freed from essentially a life sentence that only Huckabee — only Huckabee — had commuted. Ditto for any subsequent snafu in Washington.
Bad judgment. Overplayed compassion grounded in his church-based obsession with the notion of redemption. Excuse-making.
